Lunch recess

Date: Tuesday, July 11, 1995 • Utterances: 13
Judge Ito dismisses the jury for the noon recess and instructs witness Aaronson to return at 1:30. During the brief out-of-jury session, Darden raises a pending Evidence Code 352 issue tied to witness Riechardt, but Cochran announces he has pushed Riechardt's testimony to the following afternoon due to a crowded witness schedule.
1 THE COURT:

Yes. All right. Ladies and gentlemen, we are going to take our recess for the noon hour. Please remember all of my admonitions to you. Don't discuss the case among yourselves, form any opinions about the case, conduct my deliberations until the matter has been submitted to you or allow anybody to communicate with you with regard to the case. And Miss Aaronson, you may step down. You are ordered to come back at 1:30. All right. We will stand in recess until 1:30.

2 (At 12:00 P.M. the noon recess was taken until 1:30 P.M. of the same day.)

All right. Back on the record in the Simpson matter. Mr. Simpson is again present before the Court with his counsel, People are represented. The jury is not present. Counsel, anything we need to take up?

8 MR. COCHRAN:

Your Honor, can I point out where we were? 6-15--

9 THE COURT:

6-14 call back. That's where we were.

10 MR. DARDEN:

As I understand it, Mr. Riechardt is going to be testifying this afternoon. And if that is the case, we need to resolve the 352 issue.

KEY QUOTE
11 MR. COCHRAN:

No. What I've decided--he's here, but I've got so many witnesses, and you said--if I can finish eight witnesses, he would be nine, and I think that's probably pressing it a little bit. So I've asked him to come back tomorrow afternoon.

12 THE COURT:

All right. Deputy Magnera, let's have the jurors, please.

Johnnie Cochran
I've got so many witnesses, and you said--if I can finish eight witnesses, he would be nine, and I think that's probably pressing it a little bit. So I've asked him to come back tomorrow afternoon.
