Bill Pavelic was a defense private investigator who told Judge Ito that he had worked for the defense since June 14. Under oath, Pavelic confirmed that he had conducted two interviews of Rosa Lopez, associated with reports dated July 29 and approximately August 18, and said he had tape-recorded the first interview, might have related notes, and believed the materials were either at his office or residence. Judge Ito ordered him to return with the items the next morning, and the defense's failure to timely disclose the July 29 recording resulted in a continuance and sanctions requiring the defense to pay Lopez's hotel costs.
