Redirect examination of Comm. Keith Bushey (part 3)

Witness: Comm. Keith Bushey
Examiner: Marcia Clark
Called by: Prosecution • Date: Wednesday, September 20, 1995 • Utterances: 13
Marcia Clark conducts a brief redirect of Commander Bushey, clarifying that Detective Phillips never made a definitive positive identification of Nicole Brown Simpson — only that it appeared to be her based on the address. Clark then attempts a pointed rhetorical jab at Cochran for repeatedly invoking Fuhrman's name, but the question is sustained before Bushey can answer.
1 MR. COCHRAN:

Thank you. Nothing further.

FURTHER REDIRECT EXAMINATION BY MS. CLARK

2 MS. CLARK:

Do you recall whether Detective Phillips told you it was Nicole Brown or may be?

3 MR. COCHRAN:

Object, your Honor, hearsay. Hearsay.

4 THE COURT:

Overruled.

5 COMMANDER BUSHEY:

He was at her residence and I--I am quite certain that there was no conversation that he is absolutely certain that this was Nicole Brown Simpson. I believe that that is what it appeared to be, because she lived there and--but I don't--I'm quite sure--well, I'm not certain--I am not aware that there was a positive identification, but that is certainly what it appeared to be.

6 MS. CLARK:

And--you had no conversation with Detective Fuhrman that night, correct?

7 COMMANDER BUSHEY:

None.

8 MS. CLARK:

And you told that to Mr. Cochran earlier in his cross-examination, correct?

9 COMMANDER BUSHEY:

I believe so.

10 MS. CLARK:

Can you imagine why he keeps mentioning Detective Fuhrman's name?

Key Quotes (2)

Comm. Keith Bushey
I am not aware that there was a positive identification, but that is certainly what it appeared to be.
Bushey hedges significantly on the victim ID — undercutting any implication that LAPD had certain knowledge it was Nicole before arriving.
Marcia Clark
Can you imagine why he keeps mentioning Detective Fuhrman's name?
A rare moment of Clark editorializing through a question — quickly shut down, but reveals prosecutorial frustration with the defense's Fuhrman strategy.

Clark asks Bushey to speculate on why Cochran keeps invoking Fuhrman's name — Cochran objects, Ito sustains. Clark thanks the court and ends, having made the point implicitly anyway.
