Jury instruction: scheduling

Date: Tuesday, September 19, 1995 • Utterances: 2
Judge Ito addresses the jury after a scheduling conference with counsel, outlining the anticipated trial timeline: evidence to conclude by end of week, jury instructions on Friday morning, and closing arguments beginning Tuesday, September 26th. The jury is dismissed for the afternoon while the judge resolves a complex unspecified legal issue, with one witness scheduled for the following morning.

2 THE COURT:

All right. Thank you, ladies and gentlemen. Please be seated. Let the record reflect that we've now been rejoined by all the members of our jury panel. Ladies and gentlemen, I just finished a conference with the lawyers in my chambers regarding scheduling, and I've indicated to them that my anticipation at this point is that we will conclude the presentation of the evidence this week, that I will actually get to the instruction of the jury. In other words, telling you the law that applies to this case I hope to give to you this Friday morning, and it's my anticipation that we will start with the arguments of the attorneys next Tuesday, September the 26th. So we'll be making some progress. At this point today, we have no other witnesses to present to you. The reason for that is, there's some very significant legal issues that I have to resolve. Just to give you an example, these are the papers that one party filed for me to read to resolve this problem. So just to tell you, it is a complex issue and it will take me some time to deal with. So I'm going to excuse you for the afternoon today. I'm told we have one other witness that is scheduled promptly for 9:00 o'clock tomorrow morning. So we'll get started with some additional testimony, but I anticipate winding this up this week. Remember all my admonitions to you; don't discuss the case, don't form any opinions about the case, don't conduct any deliberations until the matter has been submitted to you, do not allow anybody to communicate with you with regard to the case. As far as the jury is concerned, we'll stand in recess until 9:00 clock. As far as counsel is concerned, as soon as the jury is clear, we'll reconvene on the other matters. All right. See you tomorrow.
