Judge Ito calls a recess until 8:30 AM the following morning. Marcia Clark raises a complaint that defense counsel went directly to two prosecution rebuttal witnesses, Kevin Schott and Robert Lee, and told them they had to remain until noon the next day — bypassing Clark entirely — when those witnesses had early morning flights and their testimony was complete. Clark requests the court release them. Barry Scheck professes ignorance of the situation, and Ito rules the witnesses are released.
1 THE COURT:

All right. We will stand in recess until 8:30.

Your Honor, it might be helpful to the court, you wanted references Dr. Gerdes' testimony on the stains.

Yes.

4 MR. KELBERG:

Mr. Clarke has been kind enough to bring them down. He is not sure of the volume numbers, but he has the dates of the testimony.

5 THE COURT:

All right.

6 MS. CLARK:

Your Honor, there are two witnesses that the Defense, without telling me about or asking anyone, they went directly to the witnesses, Kevin Schott and Robert Lee and told them that they had to stay until tomorrow at noon. Their flight is scheduled for eight o'clock in the morning. They had a full opportunity to review the witnesses and their testimony is complete in the People's rebuttal case. If the Defense seeks to have them subpoenaed, they may do so, and I don't see any cause for them to be required to stay longer than their flight would indicate. And I'm asking leave of the court--

Well, Mr. Sims, tomorrow morning at 8:30. Thank you.

I'm asking leave of the court to let the witnesses go.
