Redirect examination of Gregory Matheson (part 3)

Witness: Gregory Matheson
Examiner: Hank Goldberg
Called by: Prosecution • Date: Friday, May 5, 1995 • Utterances: 14
A very brief redirect examination of LAPD criminalist Gregory Matheson. After a momentary confusion about his whereabouts, Goldberg asked a single hypothetical question: if blood from the back gate showed no EDTA, would that be inconsistent with it coming from the reference vial? Matheson agreed it would be.
1 THE COURT:

Thank you, ladies and gentlemen. Please be seated. Mr. Matheson, would you--where did Mr. Matheson go? Deputy Russell, I need Mr. Matheson, please.

2 DEPUTY RUSSELL:

Yes, your Honor.

3 THE COURT:

All right.

4 (Brief pause.)
5 THE COURT:

All right. Mr. Matheson, would you resume the witness stand, please. All right. Mr. Goldberg, you may conclude your redirect.

6 MR. GOLDBERG:

Thank you.

7 MR. GOLDBERG:

Were you trying to run out on us, Mr. Matheson?

8 MR. MATHESON:

No. I was standing right in front of the door.

9 MR. GOLDBERG:

Mr. Matheson, I just want to ask you, hypothetically, if blood from this case--excuse me. Hypothetically, if blood from this case from an evidence item such as from the back gate showed no presence of a chemical EDTA, would you agree that that is inconsistent with it possibly coming from the reference vial?

10 MR. MATHESON:

Yes, I would.

11 MR. GOLDBERG:

Thank you very much, Mr. Matheson. Thank you, ladies and gentlemen.

12 THE COURT:

All right.

13 MR. GOLDBERG:

No other questions.

14 THE COURT:

Mr. Blasier.

Key Quotes (2)

Hank Goldberg
Hypothetically, if blood from this case from an evidence item such as from the back gate showed no presence of a chemical EDTA, would you agree that that is inconsistent with it possibly coming from the reference vial?
Goldberg plants a favorable hypothetical for the prosecution — if defense's EDTA contamination theory were true, you'd expect to find EDTA; if you don't find it, the theory fails.
Gregory Matheson
Yes, I would.
Matheson's agreement provides prosecution with a clean, simple logical rebuttal to the defense's blood-planting theory.
