Recross-examination of Richard Rubin (part 2)

Witness: Richard Rubin
Examiner: Johnnie Cochran
Called by: Prosecution • Date: Wednesday, June 21, 1995 • Utterances: 9
Cochran asks glove expert Richard Rubin whether snug-fitting Aris Light gloves are difficult to remove once on. Darden objects twice—both overruled—and Rubin explains the proper technique for removing fine dress gloves, noting that thumb position and finger cupping are key factors. The exchange is brief and technical.
1 MR. COCHRAN:

Thank you.

FURTHER RECROSS-EXAMINATION BY MR. COCHRAN

2 MR. COCHRAN:

Mr. Rubin, with regard to the Aris light gloves there that are supposed to be a light--a snug fit--

3 MR. DARDEN:

Objection. This exceeds direct.

4 THE COURT:

Overruled.

5 MR. COCHRAN:

It is very difficult, is it not, to get a snug fitting pair of those Aris light gloves off of one's hands once they are fitted on your hands; isn't that correct?

6 MR. DARDEN:

Objection, your Honor, the jury saw the demonstration.

7 THE COURT:

Overruled. He can tell us about what it was designed to do.

8 MR. RUBIN:

These gloves, as well as most fine dress gloves, come off easiest when the hand is extended and the thumb is tucked in toward the hand to make the glove slide up easier. Any movement of the thumb upwards would restrict going on or off, obviously, and then any cupping of the fingers would restrict the glove coming off easily.

9 MR. COCHRAN:

Thank you very kindly, your Honor.

Key Quotes (2)

Richard Rubin
These gloves, as well as most fine dress gloves, come off easiest when the hand is extended and the thumb is tucked in toward the hand to make the glove slide up easier. Any movement of the thumb upwards would restrict going on or off, obviously, and then any cupping of the fingers would restrict the glove coming off easily.
Implicitly supports the defense narrative that removing tight-fitting gloves is non-trivial, reinforcing the 'if it doesn't fit' argument after the courtroom demonstration.
Christopher Darden
Objection, your Honor, the jury saw the demonstration.
Darden's reference to the glove demonstration reveals prosecution sensitivity about revisiting it; the objection is overruled, letting the defense drive the point home again.

Notable Exchanges (1)

Christopher DardenLance A. Ito
Darden argues the jury already saw the glove demonstration and further testimony is unnecessary; Ito overrules, permitting Rubin to testify about the glove's design intent.
