Judge Ito called a brief unreported bench conference, then dismissed the jury for the evening with standard admonitions, instructing Agent Roger Martz to remain available. A second unreported bench conference was held after the jury cleared, and the session adjourned at 5:00 P.M. until the following morning.

All right. Ladies and gentlemen, we are going to take our recess for the evening at this time. Please remember all of my admonitions to you. Don't discuss the case amongst yourselves, don't form any opinions about the case, don't conduct any deliberations until the matter has been submitted to you, don't allow anybody to communicate with you with regard to the case. As far as the jury is concerned we will stand in recess until 9:00 A.M. tomorrow morning. Agent Martz, you may step down. Don't go away, though. All right. We will clear the jury and then I want to talk to counsel.
