Redirect examination of Jack McKay (part 2)

Witness: Jack McKay
Examiner: Johnnie Cochran
Called by: Defense • Date: Tuesday, July 11, 1995 • Utterances: 23
Cochran conducted a brief further redirect of Jack McKay, focusing on two points: the appearance of OJ Simpson's swollen middle finger in a June 8th photograph, and McKay's observation of Simpson limping during a golf outing. McKay confirmed seeing Simpson limp but characterized the exchange about it as casual joking about old football injuries rather than a serious complaint.
1 MR. COCHRAN:

Just two other questions.

FURTHER REDIRECT EXAMINATION BY MR. COCHRAN

2 MR. COCHRAN:

First of all, with regard to this picture, do you see how swollen Mr. Simpson's middle finger looks? Do you see his knuckle out there?

3 MS. CLARK:

Objection, leading.

4 THE COURT:

Sustained. Leading.

5 MR. COCHRAN:

Let me point it out.

6 MR. COCHRAN:

Did you notice anything unusual about that middle finger of Mr. Simpson's there? Can you see that?

7 MR. MCKAY:

I can't--I wouldn't have seen it before so I wouldn't know whether it is normal or not. I mean, that is the first time I had seen that.

KEY QUOTE
8 MR. COCHRAN:

This picture was the way, however--the way it looked back on June 8th?

9 MR. MCKAY:

Yes.

10 MR. COCHRAN:

All right. With regard to Mr. Simpson complaining, as I understood your testimony, you noticed Mr. Simpson limping and you asked him a question about that limping; isn't that correct?

11 MR. MCKAY:

Not in this is there testimony. That question was never asked. You asked me that question here today.

KEY QUOTE
12 MR. COCHRAN:

Sure. But on that particular date, on June 8th, you noticed him limping as he was walking toward his ball, right?

13 MR. MCKAY:

Right.

14 MS. CLARK:

Objection, leading.

15 MR. COCHRAN:

That is something you saw with your own eyes; isn't that right?

16 MS. CLARK:

Objection, leading.

17 THE COURT:

Overruled.

18 MR. COCHRAN:

You then commented or talked to Mr. Simpson about why he was limping?

19 MS. CLARK:

Objection, leading.

20 THE COURT:

This is leading.

21 MR. COCHRAN:

All right. After you saw Mr. Simpson limping toward his ball, what did you do at that point? Did you ask him a question?

22 MR. MCKAY:

We just said--we joked about old football injuries, just that is old football injuries, knee injuries. It was very, very brief, like in a joking way. We really didn't discuss it at all.

KEY QUOTE
23 MR. COCHRAN:

All right. Thank you very kindly, sir.

Key Quotes (3)

Jack McKay
I can't--I wouldn't have seen it before so I wouldn't know whether it is normal or not. I mean, that is the first time I had seen that.
McKay hedges on the finger swelling, limiting the value of the photo as corroboration since he had no baseline for comparison.
Jack McKay
Not in this is there testimony. That question was never asked. You asked me that question here today.
McKay corrects Cochran directly, clarifying that the limping observation came out during direct examination today — not in prior testimony — showing the witness is precise and not simply agreeable.

We just said--we joked about old football injuries, just that is old football injuries, knee injuries. It was very, very brief, like in a joking way. We really didn't discuss it at all.
Frames Simpson's limp as unremarkable and mutually dismissed as an old sports injury, softening its evidentiary weight.
