Sidebar

Date: Tuesday, February 21, 1995 • Utterances: 5
A sealed sidebar conference was held before the jury was brought in, with its contents transcribed under separate cover. Judge Ito then addressed the jury to explain the morning delay, noting that legal issues must be resolved outside their presence each morning before testimony can resume. Detective Tom Lange then resumed the witness stand.
1 THE COURT:

ALL RIGHT. ALL RIGHT. LET ME SEE COUNSEL AT THE SIDE BAR WITH THE COURT REPORTER BEFORE WE GET STARTED WITH THE JURY. (PAGES 15452 THROUGH 15455, VOLUME 91A, TRANSCRIBED AND SEALED UNDER SEPARATE COVER.)

2 THE COURT:

ALL RIGHT. THANK YOU, COUNSEL. ALL RIGHT. DEPUTY MAGNERA, LET'S HAVE THE JURY, PLEASE.

3 THE COURT:

ALL RIGHT. THANK YOU, LADIES AND GENTLEMEN. PLEASE BE SEATED. LET THE RECORD REFLECT THAT WE HAVE NOW BEEN REJOINED BY ALL OF THE MEMBERS OF OUR JURY PANEL. GOOD MORNING, LADIES AND GENTLEMEN.

4 THE JURY:

GOOD MORNING.

5 THE COURT:

AS YOU KNOW, WE NORMALLY SCHEDULE OUR RESTART EVERY MORNING AT NINE O'CLOCK, AND JUST TO LET YOU KNOW WHAT IS GOING ON WHILE YOU ARE BACK THERE IN THE SMALL JURY ROOM, WE START EVERY MORNING AT NINE O'CLOCK AND THERE ARE VARIOUS ISSUES THAT I NEED TO ADDRESS WITH THE ATTORNEYS OUT OF YOUR PRESENCE BEFORE WE GET STARTED EVERY MORNING, AND TODAY WAS LIKE NO OTHER. MY PLANNED SCHEDULE TO GET THESE THINGS DONE IN A FEW MINUTES WAS A LITTLE OPTIMISTIC, SO I JUST WANTED TO EXPLAIN TO YOU THAT WE HAVE BEEN OUT HERE ON THE RECORD WITH THE COURT REPORTER WORKING EVER SINCE NINE O'CLOCK AND WE WILL FROM TIME TO TIME HAVE TO TAKE WHAT APPEAR TO YOU TO BE BREAKS VERY SOON INTO THE PROCEEDING, BUT THAT IS BECAUSE THE COURT REPORTER AND THE STAFF HAVE BEEN WORKING A SIGNIFICANT PERIOD OF TIME AND THEY NEED BREAKS AS WELL. ALL RIGHT. DETECTIVE LANGE, WOULD YOU PLEASE RESUME THE WITNESS STAND.

TOM LANGE, THE WITNESS ON THE STAND AT THE TIME OF THE EVENING ADJOURNMENT, RESUMED THE STAND AND TESTIFIED FURTHER AS FOLLOWS:
