Court opening and jury recalled

Date: Monday, August 21, 1995 • Utterances: 4
Judge Ito reconvenes court and recalls the jury after handling matters outside their presence. He apologizes for the late start and warns jurors that a significant pending legal issue will require approximately twenty hours of his review, potentially causing substantial gaps in court time that week.
1 THE COURT:

Back on the record in the Simpson matter. All parties are again present. The jury is not present. Deputy Magnera, let's have the jurors, please.

2 (The following proceedings were held in open court, in the presence of the jury:)
3 THE COURT:

All right. Thank you, ladies and gentlemen. Please be seated. All right. Let the record reflect that we have now been rejoined by all the members of our jury panel. Good morning, ladies and gentlemen.

THE JURY: Good morning.

4 THE COURT:

My apologies to you for the late start this morning. I had a number of issues that we needed to determine out of your presence. I also wanted to give you fair warning, there is one major issue that I need to resolve with the lawyers that is coming up. My guess is that it will take me about twenty hours to examine the issues and the evidence that is being presented to me, and I anticipate using my evening hours to try to do most of that, but it may also include some court time. And I just wanted to give you a warning that there may be substantial dark time coming up this week, just so you know. All right. The Defense may call their next witness.

Signals a major unresolved evidentiary or legal issue looming — the vagueness ('one major issue') creates anticipation without revealing its nature to the jury.

Unusual candor with the jury about upcoming schedule disruption; telegraphs something consequential is being decided behind closed doors.
