Morning session opening

Date: Monday, August 14, 1995 • Utterances: 11
The court convened outside the presence of the jury to handle procedural matters before resuming testimony. Defense attorney Blasier and prosecutor Clark worked out an agreement regarding Dr. Rieders, an expert witness whose cross-examination had been interrupted when he had to leave; a new witness (Agent Martz) had since testified, and the parties agreed to allow Blasier to question Rieders about Martz's testimony without the awkward formality of recalling him to the stand.
1 (Appearances as heretofore noted; Richard P. Towne, Esquire, and Laurie J. Butler, representing Mark Fuhrman.)
2 (Janet M. Moxham, CSR no. 4855, official reporter.)
3 (Christine M. Olson, CSR no. 2378, official reporter.)
4 (The following proceedings were held in open court, out of the presence of the jury:)
5 THE COURT:

All right. Back on the record in the Simpson matter. Mr. Simpson is again present before the court with his counsel, Mr. Shapiro, Mr. Cochran, Mr. Scheck, Mr. Neufeld, Mr. Blasier. The People are represented by Miss Clark, Mr. Darden and Miss Kahn. The jury is not present. Counsel, what other matters do we need to take up before we bring the jury out?

6 MR. BLASIER:

Good morning, your Honor.

7 THE COURT:

Good morning, Mr. Blasier.

8 MR. BLASIER:

Very briefly, Miss Clark and I have talked about Dr. Rieders' testimony. As you might recall, Dr. Rieders was in the middle of cross-examination when he had to leave.

9 THE COURT:

I recollect.

10 MR. BLASIER:

We then called Agent Martz. I want to ask Dr. Rieders questions about Agent Martz' testimony. He has reviewed it and I have told Miss Clark that I have no objection if she just wants to start crossing him on that so we don't need to stop and recall him and that sort of thing. So if that is agreeable with Miss Clark, that is fine with me.

11 MS. CLARK:

Yes. I informed Mr. Blasier that will be fine and I'm not going to go through the rigmarole of having him leave and come back or walk out the door and come back, that I'm not going to be able to completely cross-examine him on what he would be saying about Agent Martz because I really don't know until I hear the direct, but I'm going to reserve some of that for cross, so I'm going to make this as expeditious as possible.
