Direct examination of Thano Peratis (preliminary hearing)

Witness: Thano Peratis
Examiner: Robert Shapiro
Called by: Prosecution • Date: Tuesday, August 1, 1995 • Utterances: 12
Judge Ito introduces the playing of a videotaped deposition of Thano Peratis from the July 7, 1994 preliminary hearing. The tape runs approximately 10 minutes. Ito notes a court-ordered edit removed from the tape before jury viewing.
1 THE COURT:

All right. Thank you, gentlemen. All right. Ladies and gentlemen, we are next going to exhibit to you a videotape of Mr. Peratis' testimony during the preliminary hearing. You will notice that there is one blip in the tape. It is an edit of some material that I ordered removed from the tape before it was played to you. So if you see that blip, that's what that is. All right. And Mr.--who's presenting this? Mr. Shapiro?

2 MR. SHAPIRO:

Yes.

3 THE COURT:

We need a statement regarding date and time of the proffered evidence.

4 MR. SHAPIRO:

Yes, your Honor. We called as a witness July 7th, 1994 at the preliminary hearing in this matter witness Thano Peratis.

5 THE COURT:

6 MR. SHAPIRO:

I'm sorry. The Prosecution called as a witness at the preliminary hearing.

Key Quotes (2)

Lance A. Ito
You will notice that there is one blip in the tape. It is an edit of some material that I ordered removed from the tape before it was played to you.
Ito preemptively explains a visible edit to prevent juror confusion or speculation about what was cut.
Robert Shapiro
The Prosecution called as a witness at the preliminary hearing... called by Miss Clark, was cross-examined by myself.
Establishes provenance: this is prosecution testimony that the defense is now introducing, a notable strategic inversion.

Evidence (1)

Defendant's 1283
Videotape of Thano Peratis' preliminary hearing testimony, July 7, 1994
played to jury, 2:12–2:22 P.M.

Notable Exchanges (1)

Lance A. ItoRobert Shapiro
Shapiro initially misattributes the witness as a defense witness before correcting himself — Peratis was a prosecution witness at the preliminary hearing, now being introduced by the defense at trial.
