Sir, directing your attention to the date of June 12th, 1994. As of that date, can you tell us what street you lived on?

10 A:

I lived on 862 Gretna Greenway.

11 Q:

Gretna green way?

12 A:

Uh-huh.

Is that yes?

14 A:

Yes.

Where in relation to 875 south Bundy is that?

16 A:

Bundy is one block east, and we share a common alley.

17 Q:

what part of your condo faces that alley, that you share with 875 south Bundy?

18 A:

The master bedroom and the kitchen.

19 Q:

Is that at the front or the rear of your residence?

20 A:

at the rear of my residence.

21 Q:

How long have you lived there, sir?

22 A:

Two years.

If you look out the back of your bedroom window, are you able to see any part of the property of 875 south Bundy?

24 A:

Yes. I'm able to see the whole north side of 875 north Bundy.

Now, as of the date of June the 12th, 1994, did you know someone by the name of Nicole brown?

26 A:

No, I did not.

Or where she lived?

28 A:

I did not.

Directing your attention, sir, to the evening of June the 12th, 1994, sunday night. can you tell us where you were in the evening, sir?

30 A:

I was home that evening.

Can You tell us what you were doing about 10:00 o'clock?

32 A:

I had just turned on the channel 5 news.

Channel 5 news?

34 A:

Yes.

Where were you watching television at that time?

36 A:

Upstairs in the bedroom, with my wife.

At some point, while you were watching the 10:00 o'clock news on channel 5, did something distract you?

38 A:

Yes. About 15 or 20 minutes into it, I heard a dog barking, sort of a plaintive wail.

Yes, but this was a pretty persistent barking, it just wouldn't stop.

Yes.

That was about 10:15 to 10:20?

46 A:

Yes.

Did the barking stop, or did it continue?

48 A:

Well, about this time, I stopped watching the news, and went down to my office, and I did a little work. And I didn't come back upstairs until about 11:00 o'clock.

At the point that you went downstairs to do some work, was the barking still going on?

50 A:

Yes, it was.

51 Q:

Did you come back up from working at some point?

52 A:

Yes, I did. I came back up at around 11:00 o'clock.

Where did you go when you came -- you say you came back up. Where did you come back up to?

Back up to the master bedroom.

And at 11:00 o'clock, can you tell us whether you still heard the dog barking?

56 A:

Yes, the dog was still barking. I remember going over to the shutters, and taking a look out for the -- toward Nicole's building. And I saw some lights on upstairs but, you know, of course, I couldn't pinpoint, you know, where exactly the dog was.

That's correct.
