Pre-trial matters

Date: Monday, May 22, 1995 • Utterances: 16
Brief pre-session housekeeping before resuming cross-examination of Gary Sims. Judge Ito checked on a pending in-camera review of back gate stains, took an unreported bench conference about a scheduling issue, and sorted out exhibit logistics with Barry Scheck before bringing in the jury.
1 (Appearances as heretofore noted.)
2 (Janet M. Moxham, CSR no. 4855, official reporter.)
3 (Christine M. Olson, CSR no. 2378, official reporter.)
4 (The following proceedings were held in open court, out of the presence of the jury:)
5 THE COURT:

Good morning, counsel. Back on the record in the Simpson matter. Mr. Simpson is again present before the Court with his counsel, Mr. Shapiro, Mr. Cochran, Mr. Blasier, Mr. Scheck, People represented by Mr. Darden and Mr. Harmon. The jury is not present. Counsel, anything we need to take up before we invite the jurors to continue and conclude the cross-examination of Mr. Sims?

6 MR. HARMON:

Just I wondered if there had been any in-camera review based on the inquiry I made yesterday about the stains on the back gate, your Honor.

KEY QUOTE
7 THE COURT:

All right. That matter was delegated to Mr. Douglas and Mr. Douglas is just arriving. We'll take that up at the appropriate time.

8 MR. HARMON:

Could we have just a moment? There's a scheduling problem that I wanted to alert you to. It doesn't have to be on the record, but I have to tell you about it today, your Honor.

9 THE COURT:

Come on down.

10 (A conference was held at the bench, not reported.)
11 (The following proceedings were held in open court:)
12 THE COURT:

All right. Thank you, counsel. Anything else we need to put on the record before we invite the jurors to join us? And, Mr. Scheck, do you know what you're going to need in the way of exhibits, because we've got sort of a zoo over here right now.

13 MR. SCHECK:

Yes. I think I have it fairly well planned. I'm going to start with that chart.

14 THE COURT:

I'm a little concerned because the smaller easel is sort of leaned up here. Just a matter of logistics here. All right. Deputy Magnera, let's have the jurors, please.

15 MR. SCHECK:

Your Honor, did we give the chart a number?

16 THE CLERK:

No.
