Morning session opening

Date: Friday, July 7, 1995 • Utterances: 19
A brief pre-session administrative check while waiting for Johnnie Cochran and Carl Douglas to arrive. Shapiro informed the court that the defense would file a written motion on the 1118 motion rather than present oral arguments, and flagged upcoming objections to photographs. The session stalled once it became clear the proceedings couldn't move forward without Cochran and Douglas.

4 THE COURT:

All right. Back on the record in the Simpson matter. Mr. Simpson is again present before the Court with his counsel, Mr. Shapiro and Mr. Bailey, Mr. Blasier, People represented by Mr. Darden. The jury is not present. Mr. Shapiro, do you want to proceed at this moment or do you want to wait for Mr. Cochran, who appears to be late?

5 MR. SHAPIRO:

Your Honor, we are going to be filing a written motion on the 1118 motion.

6 THE COURT:

All right.

7 MR. SHAPIRO:

So we will not be presenting any oral arguments on that. We will, however, have objections to photographs we would like to address.

8 THE COURT:

What's his ETA?

9 MR. SHAPIRO:

I can't tell you precisely. I expect him to be here momentarily.

10 THE COURT:

Momentarily? Is there anything else we can take up while we're waiting for Mr. Douglas and Mr. Cochran?

11 MR. SHAPIRO:

I don't believe so, your Honor.

12 MR. BAILEY:

With the Court's permission, I'll try to answer that question.

13 THE COURT:

Well, I assume they're en route.

14 MR. BAILEY:

Okay.

15 THE COURT:

Mr. Darden, anything else we need to take up?

16 MR. DARDEN:

No, your Honor.

17 THE COURT:

Did you bring enough notebooks?

KEY QUOTE
18 MR. SHAPIRO:

Mr. Kelberg is about to reopen, your Honor.

19 THE COURT:

All right. Well, I guess the two necessary parties, Mr. Douglas and Mr. Cochran, I guess we can't proceed without them.
