Noon recess

Date: Wednesday, July 5, 1995 • Utterances: 11
A brief administrative check-in following the noon recess. Judge Ito confirmed that defense counsel had the opportunity to examine color exhibits, and addressed Darden's earlier request regarding the defense witness list, which had been handed over at noon.

3 (Christine M. Olson, CSR no. 2378, official reporter.)
4 (The following proceedings were held in open court, out of the presence of the jury:)
5 THE COURT:

All right. Back on the record in the Simpson matter. All parties are again present. And counsel, over the noon hour did everybody have the opportunity to see the exhibits, color exhibits?

6 MR. BLASIER:

We have a copy of them, your Honor. We don't have a color copier so we are going to have to try and transcribe them onto a black and white and perhaps over the evening break if we could take them and have copies made.

7 THE COURT:

All right. But you have had the opportunity to examine them?

8 MR. BLASIER:

Just briefly.

9 THE COURT:

And Mr. Darden, you had a question earlier about a witness list from the Defense. Have you received a witness list?

10 MR. DARDEN:

Yes, your Honor, I have. The Defense handed us a witness list at noon today. It contains the names of apparent witnesses for whom we have no statements for and no discovery. There are others for whom we have discovery; however, it would appear that any testimony they might offer would be irrelevant to these proceedings. In any event, there will be 352 objections to just about everyone on the list and we will take that up at a later time.

11 THE COURT:

All right. I just wanted to make sure the list at least had been exchanged. All right. Deputy Magnera, let's have the jurors, please.

Key Quotes (2)

Christopher Darden
There will be 352 objections to just about everyone on the list and we will take that up at a later time.
Darden signals sweeping prosecution opposition to the defense witness list, citing lack of statements, no discovery, and potential irrelevance — a preview of upcoming witness battles.
Robert Blasier
We don't have a color copier so we are going to have to try and transcribe them onto a black and white and perhaps over the evening break if we could take them and have copies made.
Illustrates the logistical friction around exhibit handling; defense has only briefly reviewed the color exhibits.

Light Moments (1)
