Clark said possible use would depend on the witness's answers and that she would approach the court before using a transcript or attempting impeachment. After Neufeld requested advance access to the articles, Ito heard Clark's response and ended the sidebar without ordering their advance disclosure.

All right. Do we got any transcripts?

I'm sorry?

Got any transcripts of prior testimony?

Do we have any? We have. I don't know if we are going to use them or not. Depends on the answers I get.

The Court's prior ruling was that she was to provide us with all the transcripts.

No. If it comes up that they're going to use them.

Right. And I'll ask to approach before I use the transcript.

All right. What else do you have? You do have transcripts?

Yes I do. What else do I have? I think that is--well, articles, a couple of articles.

Can we see them?

No.

If she wants to go into those things, we are going to have to have a sidebar before she goes into them because there's already been a ruling, and we're then going to have to read them for the first time, and we're going to have 15-minute delays every time we come to the sidebar. I thought the whole purpose of your order to get the transcript as soon as we finished the direct and the other impeachment material was to expedite the proceedings.

We don't even get discovery from them on direct. This is amazing, what they're asking for. I'm going to ask what I think to be appropriate questions. If the answers I get are not what I deem to be truthful, then I will ask to impeach him, I will ask to approach.
