Judge Ito called a noon recess with about four minutes remaining before the break, and Darden opted to wait until after lunch to resume his cross-examination of witness Valerie. The judge issued standard jury admonitions and set a 1:30 PM resumption time, with court to continue until 6:00 PM. An unreported bench conference occurred just before the recess.
# 1 THE COURT: Mr. Darden.
# 2 MR. DARDEN: How long are we going to go, your Honor?
# 3 THE COURT: About four minutes. Do you want to start now or do you want to start after lunch?
# 4 MR. DARDEN: If it is okay with you, I would like to start after lunch, your Honor.
# 5 THE COURT: Mr. Valerie, I'm going to order you to come back then at 1:30 and we will resume with your cross-examination by Mr. Darden. You can step down now, Mr. Valerie. Ladies and gentlemen, please remember all of my admonitions. Don't discuss the case amongst yourselves, don't form any opinions about the case, don't conduct any deliberations until the matter has been submitted to you, do not anybody maybe to communicate with you with regard to the case. We will stand in recess until 1:30. And we will be in session today until 6:00.
# 6 MR. COCHRAN: May we approach, your Honor?
# 7 (A conference was held at the bench, not reported.) # 8 (At 11:57 A.M. the noon recess was taken until 1:30 P.M. of the same day.)
