A very brief cross-examination of investigator Marlow by plaintiff's attorney Gelblum. Gelblum established that Marlow participated in the sewer detail and June 28 search at the request of others, not on his own initiative, and that he generally responded to requests for help throughout the case. The examination concluded quickly and the witness was dismissed.
# 1 A: Police Department officers, they wouldn't give them the courtesy of a return phone call?
# 2 MR. GELBLUM: Objection. Relevance.
# 3 THE COURT: Sustained.
MR. P. BAKER: Nothing further.
# 4 THE COURT: Cross. CROSS-EXAMINATION BY
# 5 Q: Mr. Marlow, were you asked to help out on the sewer detail?
# 6 A: Yes, sir. I just don't remember exactly how it started up, whether it came in on the clue, or -- I don't know how that -- that particular clue developed or why we were even doing it. Maybe we were told to do it. I don't remember. I remember doing it. I'll never forget that. I'm not sure whose idea it was to do that.
# 7 Q: And were you asked to help out on the June 28 search?
# 9 Q: You didn't just walk over there one day and say, "Hi, guys; can I help out"?
# 10 A: No. They asked for volunteers for the search. They needed help.
KEY QUOTE # 11 Q: You went and volunteered?
# 13 Q: And with all the work you did in this case, did you respond to requests for help?
# 15 MR. GELBLUM: I have nothing further.
MR. P. BAKER: Nothing further.
# 16 THE COURT: You may step down.
# 17 INVESTIGATOR MARLOW: Thank you, Your Honor.
# 18 MR. LEONARD: Call Paul Tippin. PAUL TIPPIN, called as a witness on behalf of Defendants, was duly sworn and testified as follows:
# 19 THE CLERK: You do solemnly swear that the testimony you may give in the cause now pending before this court shall be the truth, the whole truth, and nothing but the truth, so help you God?
# 20 INVESTIGATOR MARLOW: I do.
# 21 THE CLERK: And, sir, would you please state and spell your name.
# 22 INVESTIGATOR MARLOW: Paul S. Tippin, T-i-p-p-i-n. DIRECT EXAMINATION BY
# 23 Q: Good afternoon, Mr. Tippin.
